Quest Forge Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Quest Forge ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

The App is developed and operated by Altynay Rakisheva (Individual Proprietorship, Kazakhstan) ("we," "us," or "our").

2. Account Registration

To use the App, you must create an account by signing in with Google Sign-In or Apple Sign-In. By creating an account, you agree to:

  • Provide accurate information through your chosen sign-in provider.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activity under your account.
  • Notify us immediately of any unauthorized use of your account.

You must be at least 13 years old to create an account and use the App.

3. Description of Service

Quest Forge is a gamified task management application with a medieval fantasy theme. The App allows you to:

  • Create and manage quests (goals) and tasks (to-do items).
  • Earn experience points (EXP) and virtual currency (Gold) by completing tasks.
  • Level up your character and allocate stat points.
  • Chat with an AI assistant named "Eldric the Wizard."
  • Customize the App with themes, vibes (audio/visual backgrounds), and wallpapers.
  • Set up recurring quests and task deadline reminders.

4. In-App Currency (Gold)

The App features a virtual currency called "Gold" that is earned by completing quests and tasks. Gold can be spent within the App to unlock cosmetic items (themes, vibes, wallpapers).

  • Gold has no real-world monetary value.
  • Gold cannot be exchanged, transferred, or redeemed for real currency.
  • Gold balances are non-refundable.
  • We reserve the right to modify Gold earning rates and prices at any time.

5. Subscriptions

The App may offer subscription plans ("Fan" and "Mega Fan") that provide additional features or benefits.

  • Subscriptions are billed through Apple's App Store or Google Play Store.
  • Payment is charged to your App Store or Play Store account upon confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • You can manage and cancel subscriptions through your device's App Store or Play Store settings.
  • Refunds are handled by Apple or Google according to their respective refund policies.
  • We reserve the right to modify subscription pricing with reasonable notice.

6. AI Assistant Disclaimer

The App includes an AI chat assistant named "Eldric the Wizard," powered by artificial intelligence (OpenAI).

  • All responses from Eldric are AI-generated content and are provided for entertainment and general productivity purposes only.
  • Eldric's responses should NOT be considered professional, medical, legal, financial, or psychological advice.
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
  • You use AI features at your own discretion and risk.
  • We are not liable for any decisions made based on AI-generated content.

7. User-Generated Content

You retain ownership of the content you create within the App (quests, tasks, task descriptions, chat messages). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the App's functionality.

You agree not to create content that:

  • Is illegal, harmful, threatening, abusive, or harassing.
  • Infringes on intellectual property rights of others.
  • Contains malware or harmful code.
  • Attempts to exploit or abuse the AI assistant.

We reserve the right to remove content that violates these Terms.

8. Intellectual Property

The App, including its design, graphics, artwork, icons, fonts, sounds, animations, code, and the "Quest Forge" name and branding, are the intellectual property of Altynay Rakisheva and are protected by applicable copyright and trademark laws.

You may not:

  • Copy, modify, or distribute the App or its content without permission.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App's branding, artwork, or assets for any purpose outside the App.
  • Create derivative works based on the App without written permission.

9. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt the App's functionality.
  • Use automated systems (bots, scrapers) to interact with the App.
  • Exploit bugs or glitches to gain unfair advantages (e.g., unlimited Gold or EXP).
  • Impersonate another person or entity.
  • Sell, trade, or transfer your account to another person.

10. Availability and Modifications

  • We strive to keep the App available but do not guarantee uninterrupted service.
  • We may modify, update, or discontinue features at any time without prior notice.
  • We may perform maintenance that temporarily affects availability.
  • We are not liable for any loss resulting from App downtime or feature changes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Altynay Rakisheva, her agents, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

  • You may stop using the App and delete your account at any time.
  • We may suspend or terminate your access if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately.
  • Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes arising from these Terms or the use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Kazakhstan.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App. These Terms supersede any prior agreements or communications.

17. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top will be updated accordingly. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
